I think it's more than the fact that one person "murdered under the law" while the other person did so outside the law. One person was involved in a legal activity as part of his livelihood and was killed in front of his church congregation.

The other person assassinated a man because he represented something the assassin believed was wrong. That person believed he had the right to judge a fellow citizen and carry out a sentence of death upon him. When this occurs in Iraq, we call it terrorism.

That's because an act like this is terrorism.
